Mortgage Deed - 1848
Charles M. Tibbs to Thomas H. Tibbs. This indenture made and entered into this 14th day of January 1848, between Charles M. Tibbs of the county of Wayne and State of Illinois of the first part, and Thomas H. Tibbs of the same county and State of the second part, witnesseth: That the said party of the first part, for and in consideration of the sum of seventy five dollars to him in hand paid by the said second party, the receipt whereof is hereby acknowledged, has granted, bargained and sold, and by these presents does grant, bargain, and sell, and convey unto the said second party, his heirs and assigns, the following described personal property now in possession of the said first party, to wit: one 2 Horse Waggon, 1 Bay Horse eight years old next spring, 1 Bay Mare seven years old next spring. To have and to hold the above described and conveyed property to the said second party his heirs and assigns forever. The condition of the above conveyances is such that whereas the above named Charles M. Tibbs has this day executed to the said Thomas H. Tibbs a certain promissory note for seventy five dollars payable six months after date, with interest from date. Now if said Charles M. Tibbs shall well and truly pay off and discharge said note at maturity together with the interest thereon, then this obligation to be void: otherwise to remain in full force and virtue. And it is expressly agreed by and between the said parties that the said party of the first part is to retain possession of said property until the expiration of said six months; but if said Charles should attempt to sell or in any other manner dispose of said property, the said party of the second party is authorized to take immediate possession thereof and to retain the same until the expiration of this time fixed for the payment of the said note. Tibbs was filed for Record on 26th January A. D. 1848 and is duly record in Book C. Pages 35 and 36. Given under my hand at Fairfield 28th Janry 1848. J. W. Barnhill, Recr.
