Deed for Burying Ground.

This Indenture made and entered into this fourth day of April, in the year of our Lord, one thousand eight hundred and forty two, Between Samuel Leech of the county of Adams and state of Illinois of the first part, and James N. Clark, Asa Atteberry and Gillison Price, county commissioners in and for the county of Wayne and state of Illinois and their successors in office of the second part.

Witnesseth—That the party of the first part for and in consideration of the sum of one dollar, to him in hand paid, the Receipt whereof is hereby acknowledged, has granted, bargained and sold, released, conveyed and confirmed and by these presents, doth grant Bargain and sell, Release, convey and confirm unto the said party of the second part and their successors in office, in Trust for the sole use and Benefit of the said Samuel Leech and such Blood relations to himself and wife as may think proper to use the same as a Burying Ground, or Place of interment for the dead and for no other purpose whatsoever all that Lot or Parcel of land situate in the county of Wayne and state of Illinois, bounded as follows (towit).
Beginning at the north east corner of the pailing around the graves of the said Leech's friends near the Town of Fairfield, thense west forty feet to a stake, thense north forty feet to a stake, thense east forty feet to a stake, thense south forty feet to the place of beginning, being part of the NE qr of section 6 T 2 S R 8 E in the district of lands subject to sale at Shawneetown to have and to hold the said lot or parcel of Lands with the appurtenances to the said Party of the second part, and to their successors in office in Trust for the uses, intents and purposes  before mentioned, and for no other purpose, Forever, according to the true intent and meaning of an act of the General Assembly of the state of Illinois entitled, "An act confirming grants of Property made for the encouragement of education and for other purposes" approved February the first 1831. And it is hereby declared and made known that the title to the said Lot of shall never be vested in the county of Wayne under any pretext whatever, but shall be held by the county commissioners of said county in Trust for the Purposes aforesaid and none other forever. And the said party of the first part doth covenant with the said party of the second part to warrant and forever defend the Title to said Lot or parcel of land to them the said party of the second part, and their successors in office against the lawful claims of all persons whatsoever.   In witness whereof I have here unto set my hand and affixed my seal the day and year first above written.

Before me the undersigned, an acting Justice of the Peace in and for the county of Wayne and state of Illinois, personally appeared Samuel Leech, who is personally known to me to be the identical person named in the foregoing and, as having executed the same and acknowledged that he executed said and voluntarily for the intents and purposes therein mentioned —

I Joseph G. Barkley Recorder for the county aforesaid do certify that the foregoing Deed of Conveyance from Sam'l Leech to the Commrs of the county of Wayne was this day Recorded in my office in Vol. "B" pages 300-301.
   Given under my hand at Fairfield this 13th day of June A. D. 1842.
